Spousal Green Card Approval for Baker from Martinique
We recently received a spousal based green card approval for a baker & pastry chef from Martinique at the Queens Field Office. Congratulations to our client!
The client was in the United States in O-1B status as a baker of extraordinary ability, and then subsequently married his U.S. citizen partner & was eligible for an adjustment of status to lawful permanent resident (i.e. a green card). Due to some errors made in prior immigration applications from his prior counsel, our client also needed a 601 waiver where we had to demonstrate that his US citizen spouse would face extreme hardship if his adjustment of status to lawful permanent resident was denied. The case was approved without a request for additional evidence.
Remember that an O-1B visa in the arts is applicable to all art forms, including the culinary arts. Furthermore, while many individuals who are in O-1B status will eventually pursue an employment based green card, it is always possible to obtain a family based green card depending on your life circumstances. I have many years of experience representing families navigate the immigration system, including applying for waivers (which are like pardons for immigration violations) if necessary.
