National Interest Waiver Approval for UX Designer from Germany
We received an approval on an I-140 National Interest Waiver (NIW) for a User Experience (UX) Designer from Germany. Congratulations to our client!
Our client came to us after receiving a request for evidence on her NIW petition that was filed by her prior attorney. We responded with additional evidence that better demonstrated how UX Design is a field of substantial merit and national importance, partly based upon government issued documents, and also included additional evidence of the petitioner’s background which demonstrated how well-positioned she was to accomplish her work goals in the United States as a UX designer. Finally, we demonstrated how it was in the interest of the United States to waive the labor certification process per the considerations outlined in the USCIS policy manual on NIW adjudications. The USCIS policy manual is a great place to look if you are considering applying for a National Interest Waiver as it lays out all of the requirements and also goes into detail on how STEM fields (which UX Design falls under) may be given favorable consideration for an NIW and what evidence should be included to get such consideration. The RFE was approved and the client is now eligible for lawful permanent residence (i.e. a green card).
When applying for any immigration benefit with the USCIS, it is up to you to provide all of the needed evidence to show that you qualify. Furthermore, while our client was granted an NIW as a UX Designer, that was based not just upon her professional title but her documented past achievements to show she is well-positioned to continue doing this work, as well as her documented concrete future employment plans which both demonstrated the national importance of her work and that it warranted forgoing the labor certification process.
