O-1B Renewal for Creative Content Producer from Thailand

We received an approval for a 3-year extension of O-1B status for a Thai national who is a Creative Content Producer. Congratulations to our client!

We represented the client on the initial O-1B application as well. He had created a business entity along with two business partners that focused on providing advertising & other online content creation for restaurants. We had demonstrated that his past production work in Thailand met the criteria needed to be considered a person of extraordinary ability, and that his new company had a distinguished reputation since it has signed letters of intent for services from high-profile restaurants in New York City. At the extension stage, we provided the USCIS with evidence of all the work he had done over the last 3-year period, including awards granted for certain advertising campaigns, and that he had additional projects to warrant granting another 3- year O-1B as an extension of status. It was approved without a request for evidence.

It is possible to have ownership of a petitioning company for the O-1B visa and we have successfully represented clients to structure an O-1B through that framework as opposed to an agent petition. Please reach out if you would like to schedule a comprehensive consultation.
