O-1B MPTV Approval for Film Producer from India

We recently received an O-1B Motion Pictures and Television approval for a film producer who is an Indian national. Congratulations to our client!

The O-1B is the extraordinary ability visa for individuals working in the arts. However, there are two separate classifications within the O-1B: one for those working in Motion Pictures and Television (MPTV), and then the standard O-1B for those in the other fields of art. The evidentiary standard is higher for O-1B MPTV petitions than for regular O-1Bs. In this case, our client had been previously working in the United States as an O-2 producer (support personnel of an O-1) but had now found independent work as a producer which necessitated her own O-1 employment status. We were successfully able to demonstrate that she met MPTV extraordinary ability classification. It was approved without a request for evidence.
