O-1B Approval for Producer & Photographer from Hong Kong
We recently received an approval for an O-1B extraordinary ability visa for a Producer & Photographer from Hong Kong. Congratulations to our client!
Our client was in the United States in O-1B status on an employer based petition for content production. Although she was work authorized, she was limited to solely doing content production and working for this one petitioning company. However,she was also an accomplished photographer & had interest from other employers for her abilities in production and photography in the advertising field. She came to me wanting to know how she could take on this additional work which was important for her own professional and artistic development. We submitted a new agent based O-1B petition, where her current employer authorized the agent to file on its behalf, and then also included deal memos from other work she had lined up both in production and photography, along with evidence of her achievements in both production and photography. It was approved without a request for evidence.
An agent based O-1B can provide for a lot more flexibility in what your work authorization than an employer sponsored O-1B or other nonimmigrant visa classifications. As an artist, the Immigration Services recognizes that your work often is gig-based and the agent based O-1B structure is permitted to account for this.
