U Visa Bona Fide Determination Approval for Ecuadorian Family

We recently received a favorable bona fide determination for an Ecuadorian family applying for U nonimmigrant status. Congratulations to our clients!

The U visa is for victims of certain crimes in the United States who have cooperated with law enforcement to prosecute the perpetrators. It can often be the only option an individual has to obtain lawful status in the United States as it waives many grounds of inadmissibility, including crossing the border. In this case, the principal was the victim of a felonious assault and he cooperated with the New York Police Department to try to apprehend the perpetrators. There are only 10,000 U visas issued annually and therefore the wait time can be extremely long; however, the USCIS will issue a bona fide determination after reviewing the applications & if it appears that the case is approvable, the applicants will receive deferred action and employment authorization while waiting for a visa to become available. In this case, the applicant, his wife, and his children will all receive work authorization while they wait for the visas to become available.
