Spousal Green Card Approval for Journalist from Germany

We recently received an approval for a green card (legal permanent residence) for a German national who was in the United States in I-1 status as a journalist.

In this case, the beneficiary’s US citizen spouse works in the performing arts and her employment is gig-based. For family based petitions, the petitioner (the US citizen or Legal Permanent Resident who wants to provide immigration status to their family member) must show that they have a sufficient income to keep the beneficiary (the immigrant family member) above the federal poverty guidelines. This is called an I-864 Affidavit of Support. For traditional employment, three years of tax returns and W-2 forms, as well as a recent pay stub, are provided. In this case, we also provided three years of tax returns to show a consistent earning potential that satisfied the affidavit of support requirements. We also included all pay stubs and checks from employment and royalties from the unfinished tax year, and a letter from the agent describing how the petitioner was sought-after as a performer, in order to demonstrate the continued ability to earn sufficient income.
