Spousal Green Card Approval for Chilean National

We recently received an approval for adjustment of status to lawful permanent resident (a green card) for a Chilean national who is married to a US citizen. Congratulations to our clients.

The beneficiary entered the U.S. as a tourist approximately a decade ago and overstayed. His spouse recently naturalized. Since she was now a U.S. citizen, the beneficiary was able to adjust status in the United States because spouses of U.S. citizens receive an automatic waiver (pardon) for being out of a status and working without authorization. Since the couple had been married for more than 2 years, the beneficiary also received a permanent 10-year green card rather than a conditional 2-year green card. It was approved in six months without an interview or a request for evidence.
