Immediate Relative Petition Approval for Iranian National
We recently received an approval of an immediate relative petition filed by a US citizen for her father who is an Iranian national. Congratulations to our client.
When a beneficiary is abroad, the immediate relative petition, called the I-130, is just the first step in the process. After this approval with the USCIS (US Citizenship and Immigration Services), the case is forwarded to the National Visa Center (NVC) for additional document collection & the completion of the immigrant visa application (DS-260). It is important to all civil documents comply with what the Department of State lists as acceptable. The petitioner must also submit the I-864, Affidavit of Support, with supporting financial documents. Once the NVC determines all documents are in order, it deems the case Documentarily Qualified and you are the beneficiary is then in queue for an interview at the appropriate US Embassy abroad.
Petitioning for a family member abroad is multi-step process that can take a long time as it is dependent on both USCIS processing times and appointment availability at US Embassies abroad. Additionally, some family relationships that are not considered immediate relatives (specifically adult children and siblings of US citizens, as well as any petition filed by a lawful permanent resident) are subject to visa backlogs which can increase the time from a few years to decades.
