Concurrent 751 & Naturalization Approval for Iranian National
We recently received a concurrent approval of an I-751 removal of conditions and an N-40- application for naturalization (citizenship) for an Iranian national based on her marriage to her USC spouse. Congratulations to our clients!
An I-751 Removal of Conditions must be filed for individuals who obtained conditional lawful permanent residence through marriage because they were married less than 2 years at the time they obtain their green card. It is filed within the 90 days prior to the conditional residence expiring. Processing times for an I-751 are very long at the moment (over two years). However, one is eligible to apply for naturalization through a USC spouse after 3 years of permanent residence (in other words, one year after filing the I-751). You do not need to wait for the I-751 to be approved prior to filing for naturalization! In fact, filing for naturalization while the I-751 is pending may and likely will speed up the adjudication of the I-751.
