Spousal Green Card Approval for Colombian National
We recently received an approval for adjustment of status to lawful permanent resident for a Colombian national petitioned by his US citizen husband at the USCIS Brooklyn Field Office. Congratulations to our clients!
For a spousal based adjustment of status, an application must have proof that (i) you are in a legal marriage, (ii) you have a bona fide marriage (i.e. you didn’t marry just for immigration benefits), and (iii) you are otherwise admissible. For individuals adjusting based on their relationship to US citizen spouses, the immigration services waives the inadmissibility grounds of unauthorized work and an overstay so long as you were lawfully admitted into the United States (although not all admissions qualify for these waivers). While the USCIS has resumed interviews for most marriage based green card applications, this particular application was approved without an interview.
